This has just happened to me, my wife stopped going to mediation a few months ago, I just tried to invite her back into mediation but she refused again.   So now it's going to be very costly going via our solicitors and the court.   I would much rather we spent the money on rehoming both of us than on legal fees, its extremely frustrating
